이용약관

제 1 조 (목적)

본 약관은 "The Digital Architect"(이하 "서비스")가 제공하는 AI 기반 명함 디자인 생성 및 관련 디지털 콘텐츠 서비스의 이용 조건 및 절차에 관한 사항을 규정함을 목적으로 합니다.

제 2 조 (서비스의 내용)

1. 서비스는 사용자가 입력한 브랜드 정보와 로고를 바탕으로 AI를 활용하여 맞춤형 명함 디자인 시안을 생성합니다.
2. 사용자는 생성된 시안 중 하나를 선택하여 최종 명함 데이터를 완성하고, 고해상도 이미지 파일(PNG)과 연락처 파일(vCard)을 다운로드할 수 있습니다.
3. 서비스는 Polar(polar.sh) 결제 시스템을 통해 유료 서비스를 제공합니다.

제 3 조 (지식재산권)

1. 사용자가 업로드한 로고 및 브랜드 자산에 대한 권리는 사용자에게 있습니다.
2. AI를 통해 생성된 디자인 결과물에 대한 사용권은 결제 완료 시 사용자에게 귀속됩니다. 단, 서비스는 품질 개선 및 모델 학습을 위해 비식별화된 형태로 디자인 데이터를 활용할 수 있습니다.
3. 서비스 내 제공되는 인터페이스, 아이콘, 폰트(오픈소스 제외) 등 플랫폼 자체의 디자인 권리는 "The Digital Architect"에 있습니다.

제 4 조 (이용자의 의무)

사용자는 타인의 저작권을 침해하는 로고를 업로드하거나, 불법적인 목적으로 서비스를 이용해서는 안 됩니다.

제 5 조 (계정 및 보관함)

1. 로그인은 선택 사항입니다. 로그인하지 않아도 명함을 만들고 결제할 수 있습니다.
2. 로그인은 사용자가 입력한 이메일로 보내는 로그인 링크로 합니다. 별도의 비밀번호는 없습니다.
3. 로그인한 사용자가 완성한 명함은 보관함에 저장됩니다. 무료 등급은 3개까지, Pro 등급은 개수 제한 없이 저장할 수 있습니다.
4. 사용자는 마이페이지에서 언제든 탈퇴할 수 있으며, 탈퇴하면 계정과 보관함의 명함이 즉시 삭제되고 복구할 수 없습니다. 해지 예약되지 않은 Pro 구독이 있으면 구독을 먼저 해지해야 탈퇴할 수 있습니다.
5. 로그인(가입)은 만 14세 이상만 할 수 있습니다. 로그인할 때 만 14세 이상임을 확인하며, 이용약관과 개인정보처리방침에 동의한 시각과 약관 버전을 기록합니다.

제 6 조 (유료 서비스 및 Pro 구독)

1. 유료 서비스는 명함 1장 단위로 결제하는 단건 상품(Normal)과 매월 자동 결제되는 Pro 구독으로 구성되며, 가격과 혜택은 요금제 페이지에 표시된 내용을 따릅니다.
2. Pro 구독은 로그인한 사용자만 신청할 수 있으며, 해지하기 전까지 매월 같은 날짜에 자동으로 갱신·결제됩니다.
3. 사용자는 마이페이지의 「구독 관리」에서 언제든 구독을 해지할 수 있습니다. 해지하면 다음 결제부터 청구되지 않으며, 이미 결제한 기간이 끝날 때까지 Pro 혜택이 유지된 뒤 무료 등급으로 전환됩니다.
4. 무료 등급으로 전환되어도 보관함의 명함은 삭제되지 않습니다. 다만 3개를 넘는 새 명함은 저장할 수 없고, 결제하지 않은 명함은 다운로드할 수 없습니다.
5. 구독의 환불은 환불 규정 제3조를 따릅니다.

제 7 조 (서비스의 변경 및 중단)

1. 서비스는 운영상·기술상 필요에 따라 제공하는 기능의 전부 또는 일부를 변경할 수 있으며, 중요한 변경은 사전에 서비스 화면을 통해 알립니다.
2. 설비 점검, 외부 서비스(AI·결제·호스팅 등)의 장애 등 부득이한 사유가 있는 경우 서비스 제공이 일시적으로 중단될 수 있습니다.

제 8 조 (책임의 제한)

1. AI가 생성한 디자인은 참고용 시안이며, 사용자는 최종 결과물의 내용(연락처·상표 등)을 직접 확인한 뒤 사용해야 합니다.
2. 사용자가 입력하거나 업로드한 정보·로고로 인해 발생한 권리 침해에 대한 책임은 사용자에게 있습니다.
3. 서비스는 천재지변, 외부 서비스의 장애 등 서비스의 귀책사유가 없는 손해에 대해 책임을 지지 않습니다. 다만 서비스의 고의 또는 중대한 과실로 인한 손해는 그러하지 않습니다.

제 9 조 (약관의 변경)

서비스는 관련 법령을 위반하지 않는 범위에서 이 약관을 변경할 수 있으며, 변경 시 시행일과 변경 내용을 시행 7일 전(이용자에게 불리한 변경은 30일 전)부터 서비스 화면에 공지합니다. 변경된 약관에 동의하지 않는 사용자는 이용을 중단하고 탈퇴할 수 있습니다.

제 10 조 (준거법 및 분쟁 해결)

이 약관은 대한민국 법령에 따라 해석되며, 서비스 이용과 관련한 분쟁은 먼저 문의하기 페이지를 통해 협의로 해결하도록 노력합니다. 협의가 이루어지지 않는 경우 관련 법령에 따른 관할 법원에서 해결합니다.

Terms of Service

Article 1 (Purpose)

These terms govern the use of AI-driven business card generation services provided by "The Digital Architect".

Article 2 (Service Contents)

1. The service generates custom business card designs using AI based on user-provided brand info and logos.
2. Users select a concept, finalize data, and download a high-resolution PNG file and a contact file (vCard).
3. Paid services are processed through the Polar.sh payment system.

Article 3 (Intellectual Property)

1. Users retain rights to their uploaded logos and brand assets.
2. Usage rights for AI-generated results are granted to the user upon payment. We may use de-identified design data for quality improvement.
3. All platform interface, icons, and original fonts are the property of "The Digital Architect".

Article 4 (User Obligations)

Users must not upload copyrighted material without permission or use the service for illegal purposes.

Article 5 (Account and Archive)

1. Signing in is optional. You can create and purchase business cards without an account.
2. Sign-in works through a link sent to the email address you enter. There is no password.
3. Cards finalized while signed in are saved to your archive: up to 3 on the Free tier, unlimited on Pro.
4. You may delete your account at any time from My Page. Your account and archived cards are deleted immediately and cannot be recovered. If you have a Pro subscription that is not scheduled for cancellation, you must cancel it first.
5. You must be 14 or older to sign in (create an account). When you sign in you confirm that you are 14 or older, and we record the time and the version of the Terms and Privacy Policy you agreed to.

Article 6 (Paid Services and Pro Subscription)

1. Paid services consist of a one-time purchase per card (Normal) and a monthly auto-renewing Pro subscription. Prices and benefits are as shown on the Pricing page.
2. Only signed-in users can subscribe to Pro. The subscription renews and is charged automatically on the same day each month until cancelled.
3. You can cancel at any time from "Manage subscription" on My Page. After cancelling you will not be charged again, and Pro benefits remain until the end of the period already paid, after which your account returns to the Free tier.
4. Cards in your archive are not deleted when you return to the Free tier. However, you cannot save new cards beyond 3, and unpaid cards cannot be downloaded.
5. Subscription refunds follow Article 3 of the Refund Policy.

Article 7 (Changes and Suspension of Service)

1. We may change all or part of the service for operational or technical reasons, and will announce significant changes on the service in advance.
2. The service may be temporarily unavailable due to maintenance or failures of external services (AI, payments, hosting, etc.).

Article 8 (Limitation of Liability)

1. AI-generated designs are proposals; please check the final content (contact details, trademarks, etc.) yourself before use.
2. You are responsible for any infringement arising from information or logos you enter or upload.
3. We are not liable for damages not attributable to us, such as natural disasters or failures of external services, except for damages caused by our intent or gross negligence.

Article 9 (Amendments)

We may amend these terms within the limits of applicable law. We will post the effective date and changes on the service at least 7 days in advance (30 days for changes unfavorable to users). If you do not agree to the amended terms, you may stop using the service and delete your account.

Article 10 (Governing Law and Disputes)

These terms are governed by the laws of the Republic of Korea. We will first try to resolve any dispute through the Contact page; if that fails, the dispute will be settled by the competent court under applicable law.
