제 1 조 (목적)

이 약관은 The Digital Architect(이하 「서비스」)가 제공하는 AI 명함 디자인 서비스의 이용 조건과 절차, 서비스와 이용자의 권리·의무를 정합니다.

제 2 조 (정의)

1. 「이용자」: 이 약관에 따라 서비스를 이용하는 사람. 로그인하지 않은 이용자(게스트)를 포함합니다.
2. 「회원」: 이메일 로그인 링크로 로그인한 이용자.
3. 「시안」: 이용자가 입력한 브랜드 정보로 AI가 만든 명함 디자인 4종.
4. 「결과물」: 결제 후 받는 고해상도 PNG(앞면·뒷면)와 vCard(.vcf) 연락처 파일.
5. 「단건 상품」: 명함 1장 단위로 결제하는 상품. 「Pro 구독」: 매월 자동 결제되는 회원 전용 상품.
6. 「공유 링크」: Pro 회원이 보관함의 명함을 다른 사람에게 보여 주기 위해 만드는 주소.

제 3 조 (약관의 게시와 변경)

1. 서비스는 이 약관을 서비스 화면 하단 「이용약관」에 게시합니다.
2. 약관을 바꿀 때는 시행일과 변경 내용을 시행 7일 전부터, 이용자에게 불리한 변경은 30일 전부터 서비스 화면에 공지합니다.
3. 바뀐 약관에 동의하지 않으면 이용을 중단하고 탈퇴할 수 있습니다.

제 4 조 (서비스의 내용)

1. 이용자가 입력한 브랜드 정보와 로고로 AI가 시안을 만듭니다. 시안을 고르면 이름·연락처를 넣은 최종 디자인을 미리 볼 수 있습니다.
2. 결제하면 결과물을 내려받을 수 있고, 결제 시 입력한 이메일로 결과물을 다시 받을 수 있는 링크(결제 요청일로부터 90일 유효)를 보냅니다.
3. 회원에게는 보관함을, Pro 회원에게는 제7조의 혜택을 제공합니다.

제 5 조 (회원 계정)

1. 로그인은 선택입니다. 로그인하지 않아도 명함을 만들고 결제할 수 있습니다.
2. 로그인은 입력한 이메일로 보내는 1회용 링크(15분 유효)로 하며 비밀번호는 없습니다.
3. 만 14세 이상만 회원이 될 수 있습니다. 로그인할 때 만 14세 이상임을 확인하며, 처음 로그인(가입)할 때 이용약관과 개인정보처리방침에 동의한 시각과 버전을 기록합니다.
4. 회원은 마이페이지에서 계정 이메일과 언어(한국어·영어)를 바꿀 수 있습니다. 이메일은 새 주소로 보낸 확인 링크를 눌러야 바뀌며, 바뀌면 기존 주소로 알림을 보냅니다.
5. 회원은 언제든 마이페이지에서 탈퇴할 수 있습니다. 탈퇴하면 계정·보관함·공유 링크가 즉시 삭제되고 복구할 수 없습니다. 해지 예약되지 않은 Pro 구독이 있으면 먼저 해지해야 합니다.

제 6 조 (결제)

1. 가격과 혜택은 요금제 페이지에 표시된 내용을 따릅니다.
2. 결제는 결제 대행사 Polar(polar.sh)가 처리합니다. 카드 번호 등 결제 정보는 서비스가 받거나 보관하지 않습니다.
3. 청약철회와 환불은 환불규정을 따릅니다.

제 7 조 (Pro 구독)

1. Pro 구독은 회원만 신청할 수 있으며, 해지 전까지 매월 같은 날 자동으로 갱신·결제됩니다.
2. 혜택: 보관함 무제한 저장, 보관함의 명함 다운로드(결제하지 않은 명함 포함), 공유 링크, 디자인 생성 한도 상향. 자세한 내용은 요금제 페이지에 표시합니다.
3. 마이페이지 「구독 관리」에서 언제든 해지할 수 있습니다. 해지하면 다음 결제부터 청구되지 않고, 이미 결제한 기간이 끝나면 무료 등급으로 바뀝니다.
4. 무료 등급으로 바뀌어도 보관함의 명함은 지워지지 않습니다. 다만 3개를 넘는 새 명함은 저장할 수 없고, 결제하지 않은 명함은 내려받을 수 없으며, 공유 링크는 열리지 않습니다(다시 구독하면 같은 링크가 다시 열립니다).

제 8 조 (공유 링크)

1. 공유 링크를 가진 사람은 누구나 명함 앞면 이미지를 보고 연락처(vCard)를 저장할 수 있습니다. 공유 링크는 검색엔진에 노출되지 않도록 설정되어 있습니다.
2. 회원은 언제든 공유를 중지할 수 있으며, 중지하면 공유용 이미지와 링크가 즉시 삭제됩니다.
3. 공유 화면에는 이 명함이 서비스에서 만든 것임을 확인하는 인증 표시(Q장)가 붙을 수 있습니다. 이 표시에는 개인정보가 포함되지 않습니다.
4. 다른 사람의 이름·연락처가 담긴 명함은 그 사람의 동의 없이 공유하면 안 됩니다.

제 9 조 (지식재산권)

1. 이용자가 올린 로고와 브랜드 자산의 권리는 이용자에게 있습니다.
2. 결제가 끝난 결과물은 이용자가 제한 없이 사용할 수 있습니다.
3. 서비스 화면·아이콘 등 플랫폼 자체의 권리는 서비스에 있습니다(오픈소스 제외).

제 10 조 (이용자의 의무)

이용자는 다음 행위를 해서는 안 됩니다.

1. 다른 사람의 상표·저작물을 권리 없이 올리는 행위
2. 다른 사람의 개인정보를 동의 없이 입력하거나 공유하는 행위
3. 자동화된 대량 요청 등 서비스 운영을 방해하는 행위
4. 법령을 위반하는 목적으로 서비스를 이용하는 행위

제 11 조 (서비스의 변경·중단)

1. 서비스는 운영·기술상 필요에 따라 기능을 바꿀 수 있으며, 중요한 변경은 미리 화면으로 알립니다.
2. 점검이나 외부 서비스(AI·결제·호스팅·메일)의 장애가 있으면 서비스가 일시적으로 중단될 수 있습니다.

제 12 조 (책임의 제한)

1. AI가 만든 디자인은 시안입니다. 이용자는 결과물의 내용(연락처·상표 등)을 직접 확인한 뒤 사용해야 합니다.
2. 이용자가 입력하거나 올린 정보로 생긴 권리 침해의 책임은 이용자에게 있습니다.
3. 서비스는 천재지변, 외부 서비스 장애 등 서비스의 잘못이 없는 손해를 책임지지 않습니다. 다만 서비스의 고의 또는 중대한 과실로 생긴 손해는 그렇지 않습니다.

제 13 조 (준거법과 분쟁 해결)

이 약관은 대한민국 법에 따릅니다. 분쟁은 먼저 문의하기로 협의하며, 협의가 되지 않으면 민사소송법에 따른 관할 법원에서 해결합니다.

Article 1 (Purpose)

These Terms set out the conditions and procedures for using the AI business card design service provided by The Digital Architect (the “Service”), and the rights and obligations of the Service and its users.

Article 2 (Definitions)

1. “User”: anyone who uses the Service under these Terms, including users who do not sign in (guests).
2. “Member”: a user who has signed in with an email sign-in link.
3. “Concepts”: the four business card designs the AI creates from the brand information you enter.
4. “Deliverables”: the high-resolution PNG files (front and back) and the vCard (.vcf) contact file you receive after payment.
5. “Single purchase”: a product paid for one card at a time. “Pro subscription”: a members-only product billed automatically every month.
6. “Share link”: an address a Pro member creates to show a card from their archive to others.

Article 3 (Posting and Changes)

1. The Service posts these Terms under “Terms” at the bottom of every page.
2. When we change these Terms, we announce the effective date and the changes on the Service at least 7 days in advance, or 30 days in advance for changes unfavorable to users.
3. If you do not agree to the changed Terms, you may stop using the Service and delete your account.

Article 4 (The Service)

1. The AI creates concepts from the brand information and logo you enter. After you choose one, you can preview the final design with your name and contact details.
2. After payment you can download the deliverables, and we email a link to get them again to the address you entered at checkout (valid for 90 days from the payment request).
3. Members get an archive, and Pro members get the benefits in Article 7.

Article 5 (Member Accounts)

1. Signing in is optional. You can create and pay for a card without signing in.
2. You sign in with a one-time link sent to your email (valid for 15 minutes). There is no password.
3. You must be 14 or older to become a member. When you sign in, you confirm that you are 14 or older, and when you first sign in (sign up) we record when you agreed to these Terms and the Privacy Policy and which versions you agreed to.
4. Members can change their account email and language (Korean or English) on My Page. An email change takes effect only after you use the confirmation link sent to the new address, and we then notify your previous address.
5. Members can delete their account on My Page at any time. Deleting your account immediately and permanently removes your account, archive and share links. If you have a Pro subscription that is not set to cancel, you must cancel it first.

Article 6 (Payment)

1. Prices and benefits are as shown on the Pricing page.
2. Payments are processed by our payment provider, Polar (polar.sh). The Service does not receive or store card numbers or other payment details.
3. Withdrawals and refunds follow the Refund Policy.

Article 7 (Pro Subscription)

1. Only members can subscribe to Pro. It renews and is billed automatically on the same day each month until you cancel.
2. Benefits: unlimited archive storage, downloading cards from your archive (including unpaid ones), share links, and a higher design-creation limit. Details are shown on the Pricing page.
3. You can cancel at any time under “Manage subscription” on My Page. After you cancel, you are not billed again, and you move to the free tier when the paid period ends.
4. Moving to the free tier does not delete the cards in your archive. However, you cannot save new cards beyond three, cannot download unpaid cards, and your share links stop opening (they open again if you resubscribe).

Article 8 (Share Links)

1. Anyone with a share link can see the card front image and save the contact (vCard). Share links are set not to appear in search engines.
2. Members can stop sharing at any time; when you stop sharing, the shared image and link are deleted immediately.
3. The share page may show a verification badge (Q-temp) confirming the card was made with the Service. The badge contains no personal information.
4. You must not share a card containing another person’s name or contact details without that person’s consent.

Article 9 (Intellectual Property)

1. You keep the rights to the logos and brand assets you upload.
2. Once paid for, you may use the deliverables without restriction.
3. Rights to the platform itself, such as its interface and icons, belong to the Service (excluding open-source components).

Article 10 (User Obligations)

You must not:

1. upload another person’s trademarks or copyrighted works without the right to do so;
2. enter or share another person’s personal information without their consent;
3. disrupt the Service, for example with automated bulk requests; or
4. use the Service for any unlawful purpose.

Article 11 (Changes to and Suspension of the Service)

1. We may change features for operational or technical reasons, and we announce important changes on the Service in advance.
2. The Service may be temporarily unavailable during maintenance or outages of external services (AI, payments, hosting, email).

Article 12 (Limitation of Liability)

1. AI-generated designs are drafts. You must check the contents of the deliverables (contact details, trademarks, etc.) yourself before use.
2. You are responsible for any infringement arising from information you enter or upload.
3. The Service is not liable for damage not caused by its fault, such as natural disasters or outages of external services, except for damage caused by the Service’s intent or gross negligence.

Article 13 (Governing Law and Disputes)

These Terms are governed by the laws of the Republic of Korea. Disputes are first discussed through the Contact page; if not resolved, they are settled in the competent court under the Korean Civil Procedure Act.
